1. Geltungsbereich / Scope

1.1 Diese Allgemeinen Geschäftsbedingungen („AGB“) gelten für alle Verträge über die Bereitstellung digitaler Inhalte (z.B. E-Books, PDFs) zwischen dem Manuel Gangl Verlag („Verkäufer“) und dem Kunden über die Website www.manuelgangl.com.
1.2 Mit der Bestellung akzeptiert der Kunde diese AGB. Abweichende Bedingungen des Kunden werden nicht anerkannt.
1.3 Es gilt die zum Zeitpunkt der Bestellung aktuelle Fassung der AGB.

1.1 These General Terms and Conditions (“GTC”) apply to all contracts regarding the provision of digital content (e.g., e-books, PDFs) between Manuel Gangl Verlag (“Seller”) and the customer via the website www.manuelgangl.com.
1.2 By placing an order, the customer accepts these GTC. Deviating conditions of the customer shall not be recognized.
1.3 The version of the GTC valid at the time of the order shall apply.
2. Vertragsschluss & Download-Bestimmungen / Contract Conclusion & Download Terms

2.1 Die Präsentation der Produkte auf der Website ist kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Bestellung. Durch Klicken auf den Button „Zahlungspflichtig bestellen“ gibt der Kunde ein bindendes Angebot ab. Der Vertrag kommt erst durch eine separate Auftragsbestätigung per E-Mail oder durch die Bereitstellung des digitalen Inhalts zustande.
2.2 Bereitstellung digitaler Inhalte: Dem Kunden wird nach erfolgreicher Zahlung ein Download-Link zur Verfügung gestellt. Dieser Link ist auf maximal 4 Download-Versuche sowie auf einen Zeitraum von 7 Tagen ab Kaufdatum begrenzt. Nach Ablauf dieser Frist oder Erreichen des Limits erlischt der Anspruch auf Bereitstellung.

2.1 The presentation of products on the website is not a legally binding offer but an invitation to order. By clicking the “Place Order” button, the customer submits a binding offer. The contract is concluded only upon a separate order confirmation via email or by providing the digital content.
2.2 Provision of digital content: Following successful payment, a download link will be made available to the customer. This link is strictly limited to a maximum of 4 download attempts and a duration of 7 days from the purchase date. Upon expiry of this period or reaching the limit, the claim to the provision expires.
3. Preise & Zahlungsbedingungen / Prices & Payment Terms

3.1 Die angeführten Preise sind Endverbraucherpreise inklusive der gesetzlichen Umsatzsteuer. Da es sich ausschließlich um digitale Inhalte handelt, fallen keine Liefer- oder Versandkosten an.
3.2 Die Zahlung ist sofort bei Vertragsabschluss fällig. Verfügbare Zahlungsmethoden sind direkte Banküberweisung oder PayPal. Alle anfallenden Transaktions- oder Bankgebühren sind vollständig vom Kunden zu tragen.

3.1 The listed prices are retail prices including statutory VAT. Since the products consist exclusively of digital content, no shipping or delivery costs apply.
3.2 Payment is due immediately upon conclusion of the contract. Available payment methods are direct bank transfer or PayPal. All applicable transaction or bank fees must be borne entirely by the customer.
4. Urheberrecht & Nutzungsrechte / Copyright & Usage Rights

4.1 Alle digitalen Inhalte (PDFs, E-Books) sind urheberrechtlich geschützt. Der Verkäufer überträgt dem Kunden kein Eigentum, sondern eine einfache, nicht-exklusive und nicht-übertragbare Werknutzungsbewilligung.
4.2 Diese Lizenz berechtigt den Kunden ausschließlich zum Download und zur Nutzung auf einem eigenen Gerät für den privaten Gebrauch. Jede darüber hinausgehende Vervielfältigung, Verbreitung, Bearbeitung oder gewerbliche Nutzung ist strengstens untersagt.

4.1 All digital content (PDFs, e-books) is protected by copyright. The Seller does not transfer ownership to the customer, but grants a simple, non-exclusive, and non-transferable license to use the work.
4.2 This license entitles the customer exclusively to download and use the content on their own device for private use. Any further reproduction, distribution, modification, or commercial exploitation is strictly prohibited.
5. Widerrufsrecht für Verbraucher / Right of Withdrawal for Consumers
Deutsch:
5.1 Verbraucher haben grundsätzlich das Recht, binnen 14 Tagen ohne Angabe von Gründen von diesem Vertrag zurückzutreten. Die Rücktrittsfrist beträgt 14 Tage ab dem Tag des Vertragsabschlusses.
5.2 Vorzeitiges Erlöschen des Widerrufsrechts: Das Widerrufsrecht erlischt vorzeitig bei Verträgen über die Lieferung von digitalen Inhalten, die nicht auf einem körperlichen Datenträger geliefert werden, wenn der Unternehmer mit der Ausführung des Vertrags begonnen hat (Bereitstellung des Downloads), nachdem der Verbraucher ausdrücklich zugestimmt hat, dass die Ausführung vor Ablauf der Widerrufsfrist beginnt, und bestätigt hat, dass er Kenntnis davon hat, dass er durch diese Zustimmung sein Widerrufsrecht verliert.

5.1 Consumers generally have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period is 14 days from the day of contract conclusion.
5.2 Premature Expiry of the Right of Withdrawal: The right of withdrawal expires prematurely in the case of contracts for the delivery of digital content not supplied on a tangible medium if the entrepreneur has begun performance of the contract (provision of download) after the consumer has expressly consented to performance beginning before the expiry of the withdrawal period and acknowledged that they lose their right of withdrawal by giving this consent.
6. Gewährleistung & Haftung / Warranty & Liability
Deutsch:
6.1 Es gelten die gesetzlichen Gewährleistungsbestimmungen. Für Schäden, die durch unsachgemäße Nutzung oder technische Inkompatibilität auf Kundenseite entstehen, wird keine Haftung übernommen.
6.2 Die Haftung für leichte Fahrlässigkeit ist ausgeschlossen. Dies gilt nicht für Personenschäden oder Ansprüche nach dem Produkthaftungsgesetz.

6.1 Statutory warranty provisions apply. No liability is accepted for damages caused by improper use or technical incompatibility on the customer’s part.
6.2 Liability for slight negligence is excluded. This limitation does not apply to personal injury or claims under the Product Liability Act.
7. Rechtswahl & Gerichtsstand / Choice of Law & Jurisdiction

7.1 Es gilt ausschließlich das materielle Recht der Republik Österreich unter Ausschluss des UN-Kaufrechts. Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als zwingende Bestimmungen des Staates ihres gewöhnlichen Aufenthalts nicht verdrängt werden.
7.2 Erfüllungsort und ausschließlicher Gerichtsstand für alle Streitigkeiten ist Graz, Österreich. Für Verbraucher gelten die gesetzlichen Bestimmungen.

7.1 The substantive law of the Republic of Austria applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that mandatory provisions of the state of their habitual residence are not superseded.
7.2 The place of performance and exclusive place of jurisdiction for all disputes is Graz, Austria. For consumers, statutory regulations apply.
